Critical Skills Required to be Successful in Patents

The IP/Patents field has several unique features that in turn determine the skill set required, like:


Thorough research skills

Adequate searches need to be done before using patents, copyrights. The applicant needs to check the relevant laws of a country or use related databases before applying for a patent, IP, copyright or trademark.

Patent, copyright or trademark search is an iterative task

To get good results for patent search, a person must determine how an invention works. Furthermore a good patent search will take a lot of time. Thus, adequate patience and ability to carry out iterative tasks is a must.


It is very difficult to prove a negative

A patent, copyright or trademark is issued for new, original, non-obvious technologies. Any invention which is original is not already registered. In all cases, a person must be able to find related solutions. It also helps to determine whether or not an invention is already patented. If it has already been patented then a person cannot obtain a patent for it.


Use of Difficult Language

A patent, copyright or trademark protects a new technology by means of a legal document. Patents consist of three types of language:


Commitment

Legal

Technical

Merely descriptive being the most difficult language. Since new original technologies do not have accepted keywords, the invention needs to be suitably described.
